. The following case showcases how Smith can sue the local garage because the duties of care are not provided to him. The case is as following:
Smith finds it difficult to start his car. Therefore, he contacts the Super Mechanic Garage in the local area and files the complaint in Friday. The mechanic assures him to inspect the car at Smith’s facility. On Saturday, the mechanic appears with all necessary parts that might fix the starting of the car. After inspecting the starting procedure, the mechanic declares that the care need ‘additional fixing’ and it should be towed to the garage only. Smith agrees to the process and on the same day, the care is taken to the local garage where it takes three days to get the car fixed. On Wednesday, Smith receives the call on behalf of the mechanic that the car is in good condition now and he can take it back home. Smith pays $1200 for the overall fixing including starting and changing of the carburetor. The mechanic assures Smith that the car will not have increased mileage with this new and advanced carburetor installed in it.
