(Colossians 3:23, New International Version) Week 1 Overview It is enticing to consider the composers of the Constitution a gathering of similar men adjusted in their grand reasoning in regards to privileges and opportunities. This suspicion makes it difficult to go against protected standards in current legislative issues since individuals appreciate the life span of the Constitution and like to think about its goals above unimportant hardliner governmental issues. In any case, the Constitution was planned to a great extent due to legitimate need following the disappointment of the principal progressive government, and it highlighted a progression of down to earth compromises among its divergent partners. It is accordingly very fitting that over 225 years after the fact the U.S. government actually expects compromise to work appropriately. The Founders were “children of the Enlightenment”. When crafting a new Constitution, they learned from history and from their own experiences. Between the Declaration of Independence, the U.S. Constitution and the All Writs Act, the American people were governed at the national level by the Articles of Confederation and at the state level by state constitutions. With the U.S. Constitution, the founding generation established a new national government. This new government was more powerful than the national government established by the Articles of Confederation, but also one of limited powers. Create a PowerPoint or Google Slide presentation that includes the essential questions below. Slide content should be no less than 7 slides and no more than 10 slides (not including title and reference slides). Use APA requirements to cite sources. Essential Questions Why did the founding generation decide to write a new Constitution? What was the Articles of Confederation, and what sort of national government did it establish? What did the founding generation learn from the state constitutions that the American people wrote before the U.S. Constitution? What was Shays’ Rebellion, and how did it influence the founding generation? What key principles underlie the U.S. Constitution, and what sort of system of government did the founding generation establish? The All Writs Act, 28 U.S.C. § 1651, authorizes federal courts to “issue all writs necessary or appropriate in aid of their respective jurisdictions and agreeable to the usages and principles of law.” Give a brief history of the Writs Act, and it’s impact on American law. The All Writs Act can apply in a variety of contexts which include law enforcement investigations, the detention of military prisoners, and in cases of complex multidistrict litigation. One of the most influential instances of implying the Act was in 2016. The FBI wants Apple to bypass the iPhone’s encrypted security system so it could obtain information within the phone to further investigate other parties who might be connected to crimes. Find a case where the All Writs Act was applied and the outcome. Do you agree or disagree with the decision? Further expand on the topics to complete the assignment with no more than 10 slides.
