The right to adoption is one of the most contested, most debated, and one of the most complicated issues in the realms of r
ights, duties, and even in the sphere of legislation. All over the world, the human propensity to adopt children and the human inclination to bestow love on those who are innocent (especially the children) has given rise to claims for adoption rights. But this surge has been continually contested by hindrances that are both explicit and implicit. In the United States even though adoption right has been conferred to myriads of individuals and couples over the years, and though it may seem that the country’s legislation in this regard is quite flexible and easily applicable in terms of favoring individuals and couples desiring to adopt children, the truth is something different. There is a difference between what is apparent and what is in real. Despite the fanfare of verdicts, advocating the right to adoption as a substantially important right, and in spite of the presence of set of laws to bring about momentum in the process of child adoption in the United States, there are rigidities that characterize the process, making it sometime impossible for individuals and couples to adopt children in the United States, and this justifies the fact that the realities of adoption rights are far away from what is theoretically depicted in the American socio-political scenario. And that is one primary reason why it should be advocated that, adoption right in the United States should be made more flexible to bridge the gap between the apparent and the reality.
From the human rights perspective, the process of adopting a child entails myriads of important aspects, ranging from ensuring protection of the well-being of the child to making sure that each and every physical and psychological need of the child for adoption is met ("Adoption And Children: A Human Rights Perspective"). Right to adoption also is ingrained with tenets like protecting and safeguarding the child from abuses of any type and such aspects have been robustly dealt with by the United States federal and state legislations ("Adoption Law: United States").
