Because of the rising crime rate and the nation's tougher stance on crime, many states have enacted legislation that eliminates discretion for sentencing alternatives, especially as it relates to repeat offenders. This legislation is referred to as "three strikes and you're out." In some states, one does not have to be convicted of a third felony to be affected by this legislation. If someone committed a misdemeanor for the third offense, it would trigger the "three strikes" law and subject the offender to a life sentence.

Impact of Three Strikes Legislation on Recidivism Rates
The ‘three strikes & you are out’ law has been designed in order to keep serious and violent felons who are in prison for a longer time. Supporters of this legislation allege that it is effective as far as reducing recidivism is concerned. Most people argue that such legislation helps in reducing the rate of recidivism as it targets repeat offenders ensuring that they stay longer in prison. For example, since inception of this law in California, research shows that the crime rate has fallen dramatically. However, critics argue that there is no evidence that the legislation reduces the rate of crime; therefore, concluding that it is futile as far as deterrent is concerned (Levinson, 2002, p.815). Despite heavy criticism, the three strikes law has eliminated recidivism in most cities that have adopted it such as, San Diego, San Francisco, and Los Angeles as it has ensured deterred repeat offenders do not continue with their violent acts (Fisman, 2008).
