Modern communication is data driven via social media and other methods and raises questions of who owns the data and how to mitigate the risk associated with data management and security. Add to that management and security of intellectual property, and the situation becomes quite complex. The complexity of the situation deepens as large companies must also manage issues of privacy and security juxtaposed against concerns for national security including the rights of government to access data and personal information. In this assignment, you will address some of the concerns and legalities associated with data management.

Write a paper (1,000-1,250 words) in which you address some of the concerns and legalities associated with data management. Include the following in your paper:



  1. A discussion of the risks associated with data management and security. What are the risks? How can they best be mitigated?

  2. A discussion of personal privacy and security as juxtaposed against the right of government to access data and personal information. How should business leaders manage this contrast?

  3. A discussion of when to engage legal counsel with regard to issues of data management and security and the right of government to access data.

Introduction
    Data management is an important part of an or
ganization in order to secure the personal information of the customers or people in a responsible manner. At the same time, the management of data is essential to increase efficiency and accountability of the management system of the organizations that are involved in gathering consumer data and e-transaction during online purchasing (Vacca, 2013). Data management is implemented in order to maintain privacy of the customers through strong policy and using technology by the organization. Although data management basically controls the personally identifiable information of the consumers’ privacy and future plan of the organization to avoid any type of concerns and legality.
Therefore, data management is considered as the most valuable assets for the organization while making business plans and business strategies to maintain better business operation (Vacca, 2013). Therefore, this paper is taken to discuss risks associated with data management and security, and mitigation strategy. This paper would also discuss about personal privacy and security as juxtaposed against the right of government to access data and personal information and ways through which business leaders can manage this contrast. A discussion of engaging in legal counsel with regard to issues of data management and security is also part of this paper.
Risks with Data Management and Security
    There are risks associated with data management and security that can be determined as leaking the confidential data and misuse of the personal information of the customers by employees or any unknown person (Surg, 2010). The other risks associated with data management and security can be seen as breaching data and misusing information for personal benefits. There are cyber criminals that also invade the security system of organization by breaking the lock or stealing password of computer system to transfer data basically of the financial information of the banks and any business strategy or innovative idea of the company (Bandyopadhyay, 2012). The vulnerability or exposure of the data management and security is also a risk of the organization that can destroy essential data through using malicious software by the cyber criminals.
