Eminem’s case - Michigan born rapper Eminem was sued for writing lyrics about a childhood bully in one of his hit songs. The bully, now an adult, sued for defamation. Eminem moved for summary disposition and won because no one would take rap lyrics as facts or truth. A judge has dismissed a defamation lawsuit filed by a former schoolmate of rapper Eminem -- and she included a rap of her own to explain the ruling. In a footnote to the 13-page opinion issued Friday, the Macomb (Mich.) Daily reported in Saturday's editions, Macomb County Circuit Judge Deborah Servitto added a 10-stanza verse that read, in part: Mr. Bailey complains that his rap is trash, so he's seeking compensation in the form of cash. Bailey thinks he's entitled to some monetary gain, because Eminem used his name in vain. The lyrics are stories no one would take as fact, they're an exaggeration of a childish act. It is therefore this court's ultimate position, that Eminem is entitled to summary disposition. DeAngelo Bailey claimed that Eminem slandered him in the song "Brain Damage" from his 1999 disc "The Slim Shady LP." The lyrics include: "I was harassed daily by this fat kid named DeAngelo Bailey. An eighth-grader who acted obnoxious, 'cause his father boxes. So every day he'd shove me into the lockers." Bailey, 32, had sought $1 million from Eminem, 31, whose real name is Marshall Mathers III. Bailey's attorney, Byron Nolen, said he was surprised at the ruling and its accompanying verse. "I don't know how the Court of Appeals would look at something like that," he said. What would be the legal argument in favor of defamation through a song lyric or any other media-based forum.
