Task One
Question One
· Work Safe Tasmania is the regulating authority for my state in order to provide safe working conditions.
· Works Health and Safety Act of 2012 is one of the major legislations which are applicable in Tasmania, my region. This act ensures to secure the rights of the employees and employers both in terms of developing safe working conditions within healthcare as well as in other sectors.
· Victoria and Western Australia are the only jurisdictions where model laws are not implemented; Western Australia is now consulting on options
to incorporate portions of the model legislation. This is why it's critical to always keep in mind the applicable WHS laws in other states or territory.
Question Two
Duty holder is the professional who is obliged under WHS to ensure employee safety under WHS. There are various dimensions or criteria that are served under this act on behalf of the workers like suppliers of goods, internal professionals or PCBU. PCBU has a primary responsibility to guarantee the health and safety of workers in the business or project, as well as those who may be affected by the work, such as tourists.
Question Three
WHS Act of 2011 interprets the duties and accountabilities that officers hold in business sectors. An officer is the person who is capacitive by position to take decisions in crucial situations to ensure that safety is provided to all employees. At the same time, they have the responsibility to ensure that the safety of the workers—which should be perceived as employees—is given precisely. At the same time, it is the duty of the officers to serve the other visitors with highest degree of care provided.
Question Four
The four responsibilities that are expected from employers are as below:
· They must ensure that formal training and skill development of the employees is carried out in the light of the best knowledge sharing method available in the organization. The employer should ensure that the employees are highly trained for their jobs.
· When it comes to give manuals of operations, their language should be understandable enough to the employees because in modern conventions, diverse work culture is created within organizations and no all of the employees are comfortable with English as a language to read documentations. Thus, employers should ensure that instructions about any procedure adopted are clear to understand.
· At the same time, while dealing with dangerous working conditions, personal protective equipments play decisive role; employers must ensure that the distribution of the personal protective means are fully supervised and done through expert management.
· There is a great need of on site management of the hazards; employers should be in the perfect frame of mind to develop a system that ensures full safety of the on site management of the employees.
Question Five
Not only the employers, but also employees hold sensitive responsibilities towards their respective organizations. Four major responsibilities in this context are mentioned below:
· Employees should ensure that the WHS Act based information is shared with them and they have participated in any process of training given to them. These training sessions are for their personal and professional wellbeing.
· Every job profile comes with specific requirements or skills in employees. Thus, they are expected to be well qualified to deal with their respected job criteria. Thus, they must carry out their license, degree or any other qualification requirements, whichever is applicable to their job context.
· The employees should be well updated about the WHS provisions and they are applicable to their job profile. They must keep this updated set of information.
· Employees are always expected to follow strict professional behaviour while working in the hazardous environment. They must check if they are provided with personal protective gears and their professional code of conduct should be in accordance with the rules and regulations of the organization.
Question Six
· A notifiable incident is referred to the event that is either direct violation of WHS provisions applied to safe work conditions or it has strong possibility to provide any harm to the physical or mental state of the employees at workplace.
· Notifiable incidents should be reported prior to their commencement to avoid any harm to the workplace conditions. They should be reported after careful assessment of the outcomes that they might serve to the workplace, putting the lives of the employees at stake in some contexts.
· It varies from incident to incident to keep the record. However, a general period of three to six months is applied to keep the record of notifiable incidents in the organizations and it is due to the fact that the formal resolution time of these incidents varies from organization to organization.
Question Seven
WHS and record keeping procedures in Tasmania are monitored in organizations under the guidelines of WHS Act of 2012, as mentioned above. These records contain the assessment of the risks, intimidating conditions that might prove to be effective in the future, recurring chances of incidents which have been notified earlier or the unprofessional management of the hazards at workplace should also be a part of organizational records with regard to develop preventive measures.
Question Eight
Due diligence is the process or professional accountability that ensures that the safety of health and workplace conditions is collectively carried out by all employees. This does not lead to the responsibility of one professional taking care of entire safety measures functioning within organization; instead, it is the responsibility of everyone involved in the system to ensure that workplace conditions are safe and all protective measures are sustained. An example of the same in WHS can be given as making the training and any other orientation as mandatory to all employees in system.
Question Nine
· Consultation is a legal necessity as well as an important aspect of risk management. When everyone involved in the work communicates with one another to identify dangers and risks, discuss health and safety issues, and work together to develop solutions, a safe workplace is more easily attained.
· Workers who carry out work for the business or activity and who are (or are likely to be) directly impacted by a health and safety problem must be consulted, to the extent that it is practically practicable. It implies that when consultation is brought forward, it gives collective opinions and a variety of alternatives that are positive towards developing safe work conditions.
· A PCBU must take into account all existing options to consult and apply the WHS provisions before moving to any decision taken to enhance the workplace safety and health procedures.
· The workers have the right to appeal for their professional interests in consultation procedure, if they perceive that the steps taken to ensure workplace safety are not in accordance with the WHS provisions applied to their criterion of work.
· Yes, it is necessary to keep the records of the workplace consultations; they serve as the referring documents for any similar condition arising in future.
Question Ten
· Model codes of practice are the documents that are published to cover the concerns of the workers related to the development of the safe working conditions.
· Hazardous manual tasks are the tasks that are operated on individual bases and they involve highly sensitive precautionary measures.
· PCBU has the duty of care as to function or intervene in the hazardous manual tasks; these tasks are mostly subjected to the process of managing the needs and expectations of the employees to cover the hazards at workplace.
· The two issues include the probability that the hazard or risk will occur. The potential for harm as a result of the danger or risk awareness of the hazard or risk, as well as methods for reducing or eliminating the risk.
Question Eleven
· There are some specific conditions like IA and IB when the hand hygiene should be applied. It refers to the conditions like touching the patients as well as after handing over the invasive equipment that is medicinal or surgical in property or at the same time, if there are non-protective means used while monitoring the patients of infectious disease.
· Employers are required by the Sharps Regulations to take specified...
