This particular assignment will revolve around discussing the relationship criminal justice system and race. In the recent times it has been observed at the starting of the twenty-first century, people tends to continue for grappling with the perceptions of as well as the reality of unfairness in the justice system.
As the assignment progress it will talk about whether the criminal justice system needs to address the disparities in the criminal justice system. Then the social and ethical justice issues connected with race in the criminal justice system. Finally, this essay will close on explaining whether the federal government must be involved more in the racial related issues within different agencies of criminal justice system.

The relationship between criminal justice system and race
When discussing about criminal justice system and race it will be incomplete without considering the ways slavery and its abolition played into this relationship. It can be stated that the “Black Codes” criminalized being black effectively in terms of making some behaviour illegal only for blacks. It consisted of absence from work, vacancy, possession of firearms as well as insulting acts or gestures. Throwing light on the above-mentioned discussion it can be stated that there was no doubt these acts no doubt have common at time making these laws open for interpretation along with it easy manipulation that indicates the fact that the black people are easily targeted and also punished them. Hence, once slavery was no more, a criminal justice system was created by South on the basis of criminalizing the black people for making sure their continued oppression. That punishment of the black criminals would more or less result in their forced labour and it must not come as a surprise (Clair, 2020). On the contrary, the Thirteenth Amendment ended the concept of slavery and also at the same time made forced labour an accepted form of punishment for the people who are found guilty in terms of criminal acts. Hence, many blacks Southerners went from being slaves to criminals who was legally and easily taken away by the similar constitutional amendment that had main aim of protecting the freedom. It can be stated that the number of incarnated blacks grew extensively and at the same time so did the popular belief about the black community. Furthermore, the racialization of the criminal justice system in terms of America had started.
There were continued efforts for criminalizing the black people from 1900’s. The African American was not only the targets of the Jim Crow laws that started in the early 1900’s but there were other non-white groups who were signed out also.
In the recent times for example, mass incarceration stands as a legacy of the past abuses and continuously limit the opportunities in the most vulnerable communities. In the U.S. the incarceration rate is highest as more than 2.3 million Americans are in prison at present. However, 70% of these prisoners are non-white. On the contrary, as per some of the studies it has been informed that ethnic/racial minorities are sentenced in a more harsh manner when compared with white people even after legally relevant factors like the seriousness of the offence and previous criminal record were taken into consideration (Lang & Spitzer, 2020).
Throwing light on the above-mentioned discussion it can be stated that shifting beliefs in terms of crime and race had serious implications for the black Americans in the first half of the 20th century, the racial disparities in the population of prison doubled in the north side. The boom of incarceration changed the transition to adulthood for a lot of generations of the black men.
Does the criminal justice system needs to address the racial disparities?
In general racial disparity tends to refer to the incongruities as well as the imbalances between the treatment of the racial groups that consists of income, economic status, societal treatment, housing options and also the myriad of the other aspects related to the society and life (Owusu-Bempah & Gabbidon, 2020).
Arguably, the racial disparities in the U.S. is on the rise and there are a lot of reason behind it like the unemployment, years of home ownership, education, income of the household, inheritance, lack of upward mobility, etc. However, under slavery, the African Americans were treated in a proper manner. After the American Civil War, the Black sharecroppers became highly trapped in debt. Therefore, it is needless to say that the criminal justice system needs to address this racial disparity at present. Interestingly there is racial disparity in the criminal justice system also.
