In this Unit we've explored tort law and its application to the legal environment in which business operates. Through your reading, you've learned how tort law can be used to assign societal duties, assess legal consequences, and distribute the burden of liability among parties in our society. Some would say that tort law serves to further sound public policy by promoting the public good.


Using the Kean library, locate and read an article about a recent tort claim where a business is either the Plaintiff or the Defendant, then answer the following questions based on what you've learned in the Unit and the article you've read:



  1. Do you believe that tort law furthers public policy? Why or why not? Use at least one example from the materials to support your answer to this question.

  2. Do you think that there are aspects of tort law that are contrary to sound public policy? Why or why not? Use at least one example from the text to support your answer to this question.

  3. Describe the tort claim in the article you've read. If the case has resolved, what was the resolution? If the case hasn't yet resolved, what is your prediction for the resolution of the case?

  4. Does the resolution of the tort claim in the article you've read further public policy? Why or why not? If you represented the Defendant in the tort claim, would you advise the Defendant to conduct itself differently in the future to promote the public good and/or avoid liability?

ed that a tort in the common law jurisdiction is specifically a civil wrong that tends to cause a claimant for suffering harm or loss that results in the legal liability for an individual who commits a wrong act. Moreover, it can also consist of the intentional infliction concerning of the emotional negligence, distress, injuries, financial things, etc. Throwing light on the above-mentioned discussion it can be stated that yes it can be agreed that that tort law tends to expand public policy, in such a manner that public policy must update, adhere, as well as conform to the various types of tort that takes place in business law on a daily basis (Deakin & Markesinis, 2019). On the other hand, there are different types of tort that ranges from the intentional torts such as defamation, negligence torts that results or causes in accidents along with it have a civil responsibility, other types of torts may consist of the strict liability torts, but it is not limited to this, in a business case, a firm may tends to produce a product that is defective. It is quite evident in the scandal of the Volkswagen that took place in the year 2015 where the firm mainly decided for including a mechanism within its vehicles that mainly regulated its emissions in a deceitful manner as well as it is needless to say that it allowed them to pass the test regarding the environmental pollution which was not possible without that mechanism. It is observed by everyone that public policy should consider the various scenarios where the tort law is applicable for regulating the human accountability along with it behaviour in an installed manner.
