Recently, there was filing of lawsuit by the United States Department of Labor’s Office
of Federal Contract Compliance Programs (“OFCCP”) agains
t Oracle India because of existence
of discrimination for hiring and compensating its employees. Moreover, it also did not provide
the records of salaries and payments done to its employees during the last financial year. The
complaint was initiated by OFCCP which housed around 7,000 employees in the headquarters of
Oracle Redwood Shores, California during the year 2014 (II, January 25, 2017).
Under the specific acts named as the Rehabilitation Act and the Vietnam Era Veteran’s
Readjustment Assistance Act, the company holds no right to discriminate on the basis of caste,
color, race, sex, status, origin and disability. Moreover, there should be provision of equitable
opportunities of employment for all the employees and the job applicants by the company. After
inspection of the records of employees by OFCCP, it was found that a lot of discriminatory data
were found which was stemmed against Asians and Americans including women who were well
qualified. It included the job titles and departments like Information Technology, Support
Positions and Product Development which prominently encompassed around 80 titles of jobs.
The wrong deeds on the part of the company clearly violated the executive order 11246 as it
favoured Asian applicants instead of hiring White, African Americans and Hispanic race
individuals in higher end jobs such as...
