Case of M/V SAIGA
The M/V Saiga was a Saint Vincent as well as the Grenadines-flagged oil tanker. The M/V Saiga was a long bunker boat delivering fuel oil to fishers and other merchant ships cruise it off, of the shore of Georgia at the time of the collision that led towards this petition. The M/V Saiga invaded Guinea's particular free trade zone on the Guinean islands of Alcatraz on October 27, 1997, after crossing the sea border separating Guinea and Guinea Bissau.
The M/V Saiga was apprehended by Guinean Immigration navy vessels on October 28, 1997. The boat was taken into Conakry, Guinea, same day, when it and its personnel were arrested (Jiang et al., 2020). The Government of Saint Vincent and the Islands argued that the Courts might order the ships, her freight and sailors to be freed forthwith with no need for a bail. Nonetheless, the Respondent was willing to offer whatever collateral, the Panel deemed reasonable.
Guinea asked that the Defendant's case be dismissed by the Commission (Persaud, 2019). The Court began by determining whether it had court to hear the Application pursuant Article 292 of the Agreement. The Tribunal then addressed Guinea's argument that article 73 of the Protocol could not be used to support the application since no deposit and perhaps other assurance had already been provided or deposited.
