It also describes the area under assessment and explains all the control measures which can be taken in the situation. The document has names of assessor and supervisor. The employer’s duty of care involves protecting the health, safety and welfare of workers and the other people who might be influenced by the work (Health and Safety Executive, n.d.). They need to assess and control the risks of injury and any kind of damage at the work site. They need to provide the workers with the information regarding persistent risks at the workplace and should inform the workers about how they are protected. They should provide training to the workers about providing you training about dealing with the risks. The employers are responsible for consulting with workers directly or through representative on safety and health issues.

If a business chooses to have direct, regular contact between employer and employees instead
of appointing a WHS Committee or appoint WHS Representatives, have they failed to meet the

No, It is not legally required to have an elected WHS Representative or WHS committee, until any staff member requests the employer to conduct elections for representative (Grammeno, 2018). The employer may directly consult the workers regularly about the work and safety related issues. However this mechanism of consultation should be agreed upon by all the workers. The consultation may be relatively informal, as long as the aforesaid conditions are met.
