“The Perfume Shop, Main Street, Baltimore, MD, USA, agrees to buy 100 bottles of PepeLepeu perfume
from Frenchy’s Perfume Factory, Paris, France, for US$10 per bottle.”
“The Perfume Shop will arrange transport of the perfume to itself in Baltimore.”
Answer the following questions:
1. What law applies to this agreement? Provide a step-by-step analysis leading to your conclusion
CISG applies to this agreement. This is a contract of sales of goods and the CISG applies to the
contracts of sale of goods between the contracting States. The contracting States include the
following nations: Mexico, Canada, Japan, China, Germany, France and Russia. The CISG does
not apply to the contract of services. It does not apply to sale of goods for the personal and
household use. For example, CISG rules would not apply to sale of camera or any other personal
item to the foreign tourist. CISG is applicable to the foreign buyers and sellers or manufactures
and suppliers of the foreign counties. Under this case, the Perfume Shop situated in the US is
the seller agrees to buy 100 bottles from the France supplier. The France comes under the
contracting Sates defined in the CISG rules. Hence, here is an agreement of sale of goods
