Juvenile Justice System: A Briefing on the Proposed Policy
NSW Minister for Justice, Laura Norder, has proposed that if re-elected the government
is going to bring some comprehensive changes to the present ju
stice system and specifically in
respect of juvenile crimes. Norder has proposed that to bring back the trust of people on law and
order of the land the government, if re-elected, would be introducing tough mandatory custodial
penalties for a range of offences and changes will be ushered in the realm of juvenile justice
system. Moreover, Norder has also assured that crimes like shoplifting would be also handled
strictly by the government, if re-elected. So, keeping in mind the proposal of the Minister of
Justice, the primary endeavor in this paper is to analyze the present juvenile justice system, the
patterns of offending, the presumable effects that can be rendered by the proposed changes on
the young people, and the societal and political consequences that such changes can bring along.
The nature of juvenile crimes have changed drastically over the last few years and it
should be admitted that after the 1990s “Juvenile crime grew more serious and violent, the rate
of offending by females increased disproportionately, youth began entering the juvenile justice
system at younger ages, and gang involvement became more prevalent” (Stone n.d.). But it
would be a folly to consider that the rate of juvenile crimes is on the rise and it is increasing with
a tremendous velocity. And this argument can be supported by a report prepared by Puzzanchera
and Adams (2011) for the Office of Juvenile Justice and Delinquency Prevention (OJJDP)
regarding the rate of juvenile arrests that took place in the year 2009. The report shows some
interesting figures and this indicate that the rate of juvenile crimes across the different states of
the United States is actually going through a downward slope. According to the report
(Puzzanchera & Adams 2011), “juvenile arrests for violent offenses declined 10% between 2008
and 2009, and overall juvenile arrests fell 9% during that same period. Between 1994… and
