Mary said she found a half-smoked marijuana joint in her son’s room when she was cleaning, and she is worried that he maybe experimenting with drugs. Legal Implications
The case reflects the legal issues of the substance abuse and the inherent context of child abuse with an
effective consideration of the influence of drug use by the mother on the child. It is found that Mary is addicted to smoking marijuana when her son is at school and it is effective from the case study that she mostly remains addicted. She has been struggling with addiction to alcohol and other addiction that has been quite disruptive in her personal life. The legal issue that is quite convincing in this particular case study is the use of marijuana which is explicitly illegal in terms of addiction issues. In terms of the legal context, the mental well-being of the 15-year-old son Toby is also taken into consideration because an additive parent cannot have a good parenting attitude and it is effective that this is hampering the growth and the prospects of the child. The legal issues can also check in terms of child abuse. Because many parents who abuse substances also neglect to abuse their children, it is a common aspect for the clients in the substance abuse treatment to have contact with some part of the child protective services system.
This is effective in terms of the organizational rules and the effectiveness of the child protective services system and agency that takes into account the Welfare of the child and the responsibility for investigating and processing child abuse and neglect cases. This is considerable for the above-mentioned that as Mary remains addicted, she is not properly taking care of her child and it relates to the legal aspects of the context that are influenced by the child welfare policies (Wangensteen et al., 2020).
There are a number of state and federal laws that are effective in terms of considering the statutes of outlying certain acts of conduct. State criminal statutes have been effective in terms of outlying the act and there are state civil statutes that prohibit child abuse and neglect. There are mandatory reporting laws that require certain categories of people to report the suspected child abuse or neglect that the child is experiencing. The laws relating to the state family reservation laws offer families certain services or require families to participate in substance abuse treatment for the types of counselling that are effective in terms of the future of the child who is associated with that particular family. The first track adoption laws that limit the time of child may remain in foster care before the state brings proceedings to terminate the parental rights and the aspects that free the child for the adoption is also a legal aspect that is quite vindictive in this particular case scenario. Federal laws require the state to adopt policies, goals and the time limits in the child welfare realm.
Research Prospects
Every state has defined the designated group of individuals who are responsible for reporting incidents or suspected child abuse and child neglect. In this case, the scenario when Mary is found with half-used marijuana in Toby’s room has to be Mary who will be responsible for mandatory reporting about the statutes including the substance abuse treatment. This can effectively help us to take into account the substance abuse treatment so that Toby is not neglected and perhaps he does not engage in the addiction as his mother. In this particular aspect if Mary...
