liable (that is as an aider and abettor) of Riff’s death.
17. Assume you are Ice's attorney. Argue why Ice should not be held vicariously
liable for Bernardo's death.
18. Using the same facts as above, assume that Bernardo survived and is charged
with the murder of Riff. Explain how Bernardo could be guilty of murder even
if he only intended to hurt Riff by slicing him with an “S,” and not kill him.
19. Assume after the fight, but before being arrested, Tony runs to the corner store
owned by Doc. Doc is Tony’s friend. Tony tells Doc what happened. Doc then
allows Tony stay in the store and Doc also gives Tony some money so Tony
can get a bus out of town the next morning. What, if any, crime is Doc guilty
of? Explain.
20. Assume that at the autopsy of Riff the Medical Examiner (coroner) concludes
that the cause of death was exsanguination (bleeding to death) as a result of
the stab wound inflicted by Bernardo. The Medical Examiner, however, also
discovers that Riff had a brain aneurism. The Medical Examiner concludes,
“Riff was going to die from the brain aneurism within a few minutes, even if he had not been stabbed by Bernardo.” Explain why this does, or does not,
make any difference.
