Being able to read and understand a judgment is a new skill that you are expected to acquire during this course. Throughout the class, you have learned about the way judgments are structured and key terms that you are going to encounter as you read the various cases in your textbook.


For this assignment, you will be required to read and write a maximum 1,000 word count brief about one of the following cases:




  • Morland-Jones v. Taerk, 2014 ONSC 3061 (If your last name is from A - E)


  • Jordan House v. Menow,[1974] SCR 239 (if your last name is from F - K)


  • Wicks Estate v. Harnett,2007 CanLII 19622 (ON SC) (if your last name is from L - P)


  • R. v. Elliott, 2017 BCCA 214 (if your last name is from Q - U)


  • Crocker v. Sundance Northwest Resorts Ltd., [1988] 1 S.C.R. 1186(if your last name is from V - Z)


A sample case brief is included in the Module for Week 10.


A case brief contains the following headings:



  • Case name and neutral citation

  • Facts

  • Procedural history: Under this heading write where has this case been? who appealed?)

  • Issue(s): What is the question of law that the judges are looking to answer?

  • Analysis: How did the majority of judges analyze the issue? Is there any dissenting opinion? What did the dissenting judge think?

  • Holding: What was the outcome of the case? Was the appeal allowed? Which party was successful? Was an accused acquitted?

  • Ratio: This is the legal principle that emerges from a case. How will future cases use this case as precedent? You should state the ratio as a general statement - where in a sentence you summarize the law as it relates to your issue.

  • Discussion: Here is where I want you to engage with the case in a critical way. How does this case add to what we read about in the textbook on this topic? Do you agree with the outcome - why or why not? Does this case change something that we learned about? There is a good chance that the case that you have been assigned is not in the textbook.If that is the case, then what does that case add to what is discussed on that topic in the case book?



Include your word count for the short essay on the title page of your assignment.Your title page and references do not count towards your word count, but in text citations do.


Please note that late written assignments will have 10% per day deducted from the grade (weekends are one day).
