Jane Smith Professor McCarrick PLST 220-B02 February 24, 2020 Article Review 1 On the 21st of January, 2020, the Supreme Court announced that they will be allowing residents of Flint, Michigan to sue for damages incurred by lead contaminated water beginning in 2014. During a financial crisis, Flint decided to switch their water source from Lake Huron to the Flint river. “The corrosive water caused lead to leach from the pipes”, Reuters.com reported. Lead poisoning is known to be a cause of many cognitive deficiencies in children. Not only that, the water also caused 12 people to die from Legionnaire’s disease and hospitalized many more. Though mild side effects, 25,000 people also reported hair loss and rashes due to the lead infested water. The case was originally filled in 2016 and calls the event, “a government created environmental disaster.” Andrew Chung, U.S. Supreme Court lets Flint, Michigan residents sue over water contamination, 2020, https://www.reuters.com/article/us-usa-court-flint/u-s-supreme-court-lets-flint-michigan-residents-sue-over-water-contamination-idUSKBN1ZK1S5 (last visited 26 January, 2020). “Before filing any lawsuit, an attorney must determine that a cause of action, or legally recognized right to sue, exists.” Peggy N Kerley, Joanne Banker Hames & Paul Sukys, Civil Litigation 3-10a (2015). “The cases center on the Constitution’s 14th Amendment guarantee of due process under the law, which can protect people from government-induced harm to their personal security or health, a legal principle known as bodily integrity.” Chung, supra. Because of “bodily integrity” the residents of Flint have a right to a clean and reliable drinking source. It is shameful that a city in America was reduced to third world- like all because their government wanted to save a few dollars. What is also shameful is how long it took for this matter to make it to the Supreme Court. 4 years it has almost been, but the plaintiffs were forced to go through the hoops of the legal system beginning with the 6th Circuit, which is the area where Flint is located, presided over by Justice Sonia Sotomayor. PLST 220- CIVIL LITIGATION James Patrick McCarrick Esq.’s BLUEBOOK, DISCUSSION BOARD, and QUIZ Taking Tips Dear Students, I have compiled some tips and guidelines for doing well on our Quizzes and Discussion Boards as well as an introduction to how to cite sources in BLUEBOOK format! Please keep this information handy for your weekly assignments and please pay particular attention to the BLUEBOOK Citation Quick Guide* for our specific class below! **In addition, I have added a Sample Discussion Board in the assignment instructions section under Discussion Boards for you to use as a guide! To locate it, first click on Course Content (left hand side of our homepage); then click on Course Guides and Assignment Instructions; then click on Assignment Instructions; then click on Discussion Board; and then click on Sample Discussion Board! The Sample Discussion Board shows the use of underlining in Bluebook format but italicizing titles as seen below is also perfectly acceptable in proper Bluebook format! Tips/Advice For Doing Well on Quizzes · I recommend that you answer the questions you are reasonably sure of the correct answers first. · Then, go back and answer the harder questions with open book and your notes.   · I recommend that you use the entire time allowed for the quiz.   · If you are almost out of time, then guess.   · Do not leave questions unanswered. · If you get an answer wrong but can justify your answer, please send me an email.  If I agree with you I will give you full or partial credit! Tips/Advice For Doing Well on Discussion Boards and for Using BLUEBOOK Citations · All initial Threads should be at least 300 words in length and please answer all of the assigned questions. · All initial Threads should cite at least 2 separate and different (not the same source used twice!) in BLUEBOOK format (our textbook; another textbook; the Bible; a website; or other sources). · 2 separate Replies to two separate students are required of at least 125 words each. · Each Reply should cite at least 1 source in BLUEBOOK format. · Replies to other students’ threads should contain constructive feedback that forwards the academic discussion of the weekly topic- please do not just critique another classmate’s format, style, etc. · In proper Bluebook form of citation, you would cite right after the end of your sentence in your writing. You may either underline or italicize titles in proper Bluebook format- just please choose one style for all of your citations. So, if you took your information from page 17 of our textbook, for example, then at the end of your sentence you would have a citation for our textbook to page 17. It would look like this: Peggy Kerley, Joanne Banker Hames & Paul Sukys, Civil Litigation 17 (7th ed. 2015). OR, Peggy Kerley, Joanne Banker Hames & Paul Sukys, Civil Litigation 17 (7th ed. 2015). · For those of you who are using the digital textbook that has no page numbers- Cengage, please just state the section location of your information. For example, if you gathered information from section 1-5a, then it would look like this: Peggy Kerley, Joanne Banker Hames & Paul Sukys, Civil Litigation 1-5a (7th ed. 2015). OR, Peggy Kerley, Joanne Banker Hames & Paul Sukys, Civil Litigation 1-5a (7th ed. 2015). · Please make sure that there are periods “.” at the end of all of your citations as well! · Please post the word count at the bottom of your initial Thread and Replies: Ex: (word count: 335) Legal writing is governed by a book entitled, “THE BLUEBOOK: A UNIFORM SYSTEM OF CITATION.” *BLUEBOOK Citation Quick Guide For Our Class: PLST 220 The following types of citations will generally be used by you throughout this course: 1.
