Task:


“In relation to two of the classes in the non-judicial review section of the course (Classes 4-13) “critically assess whether the New Administrative Law package is suitable to deal with the relationship between the citizen and the state in 2017.”
*Note - Treat Classes 5 and 6 on Freedom of Information (FOI) as being 1 class for the purposes of this essay.
General Points
Your essay will have a maximum of 2500 words (including everything as per the Faculty’s word count policy).
Conciseness, without losing clarity, will be a necessity.

The seminars and lectures will help prepare you for Essay 1. The Essay will be marked on the basis that you attended all the lectures, seminars and have undertaken and critically reflected upon a number of key readings on the areas you have selected (ie FOI and Ombudsman or Reasons for Decisions and Whistleblowing etc).
The marking will be based on the quality (and not the quantity) of your research and on the level of critical, reflective and evaluative thinking you can demonstrate on the topic/question and readings.
Given the word restrictions students are encouraged to focus on a particular aspect of the question/topic rather than to try and present an exhaustive response to the general topic or question.

You are also writing for an informed readership. The marker will have read everything you have included in your paper (and have read a few thousand essays and a few PhD theses based on the topics you are writing on). Therefore you do not need to spend time outlining what certain authors, law reform bodies have written or to explain ideas or concepts (ie Stiglitz’s idea of information asymmetry etc). The marker wants to see your analysis and your arguments using that material and those ideas or research.
Don’t hesitate to grab some time with Rick Snell to ask questions, bounce ideas off or to clarify your uncertainties. You are judged on what you present at the end of Week 7 not what you didn’t know at the end of Week 3 or the end of Week 6.
