1. Introduction
By the rectitude of this specific essay, I have chosen this topic, on the issues that highlights the criminal proceedings, which is a consequence of killing and abuse that most often ta
kes place at home and various other domestic places. I think that this context is widely misunderstood for both the cases of male as well as female while implementing the partial defence policy for provocation as a part of abuses committed from the intimate partner homicides. In term of gender inequality, no doubt the woman in this regard suffers the most out of domestic violence.
However, in some cases, both men and women are found to apply the self-defence policies in a wrong perspective and therefore providing a delinquent information to the society. This paper will highlight women’s battle against this dominated masculine society, homicide, domestic violence and stream with the arguments of how battered woman syndrome framework helps to understanding the women’s defensive violence and how judicial understandings of the context of domestic violence are adequate to accommodate women who kill in self-defence. Further, in term of recommendation improved access to justice in term of intimate partner violence is highly recommended.
2. Background Highlighting the Issues
The woman in term of gender inequality had to suffers the most and face the domestic violence on a regular basis. Especially in the minority groups the woman are subjected in several forms of discrimination with no rights to take their own life decisions. These people suffer from several intergenerational consequences of the past welfare practices such as removing and dislocating their child totally from the Australian culture and tradition and providing them a socially disadvantaged and a condition of poverty experiences. As an outcome of poverty and unemployment, the crime rate increases, which give rise to domestic violence, rape as well as robbery. A clear diagram is attached below, which highlights the violence rate by the intimate partners.
Females of age between 18 to 25 to 34 experienced higher rates of intimate partner violence than the female of another category. From the above statistic chart, it is clear that the victimised are mainly the females and they are sexually, emotionally and mentally assaulted.
These statistics clearly depict the violent victimised rate as well as the offender relationship and victim gender. The fatal intimate partner violence includes homicide or murder or wilful killing of one human being by another. The total estimated number of intimate partner homicide victims in 2007 was 2,340, including 1,640 females and 700 males.
This is a clear depiction of Homicide of intimate partners by gender of victims.
Homicide victims killed by an intimate partner declined from an estimated 3,300 in 1993 to an estimation 2,340 in 2007.
Theoretical Context of Women's Homicide
The women belonging to this group had to struggle to confirm the psychological and security safety issue in order to protect their families, as they had to work day and night to provide food to their children and maintain minimum living quality in order to survive. Women too had to work in fields as a labour due to the lower income level of their men and they were forced to work as a servant, domestic helps and prostitutions with a minimal salary (Tomsen & Gadd, 2019). They had to perform several unwilling activities and they are often subjected to human trafficking. The women out of fear or suppression fails or rather ignore to understand the concept of domestic violence and as an outcome of this; they fail on self-defence.
However, now the scenario has changed a lot. The women have now achieved the power of human rights. In term of Human rights, the Australian government presented several social justice reports affecting the various laws and policies regarding the deprived and abused woman so that each of them in these groups can get equal service unbiasedly. Initiations are executed in order to build a strong and deeper relationship between the Australian government as well as the women belonging to the minority group.
According to Freeman and Staley (2018), the act of educational system, employment system and other fundamental rights were implemented by The Australian Government for the minority groups and with the help of this, the women are now allowed to educate themselves and perform self-defensive activities whenever required.
