Using what you’ve learned this week, consider each of the following sentencing scenarios. List what your sentencing recommendation would be in each scenario, and why. You may submit this paper as a series of single spaced paragraphs corresponding to your recommendations. APA formatting is not required this week, but always cite and reference authority if included in your responses.




Scenarios (offense is given first):

1. Possession of Heroin – Felony: 1st offense, no prior criminal history, 18 years old;

2. Misdemeanor Theft: 20-year-old college student, $150 worth of calculators from Staples store, no prior criminal history;

3. Grand Theft Auto: Chronic, career criminal thief; been to prison one time 15 years ago; no violent crimes;

4. Grand Theft Auto: Now add to the facts of number 3, defendant has a diagnosed attention deficit disorder and has 3 kids to support;

5. Armed Robbery with Firearm: Sentenced to prison 3 times prior for minor felonies, on parole when committed this offense;

6. Aggravated Domestic Battery: Mentally ill offender (diagnosed paranoid schizophrenic), aggravated domestic battery of his mother with a pipe;

7. Driving Under the Influence of Alcohol – Misdemeanor: Veteran, PTSD, Traumatic Brain Injury from combat, weapons trained;


8. Aggravated Assault: Same facts as #7, but change the offense to threatening to attack his wife with a metal pipe;

9. Possession of Cocaine – Felony: Drug addicts, seeks treatment, prior sentence to prison for non-violent offense;


10. Possession of Cocaine – Felony: Same facts as #9, but change his prior prison sentence to a conviction for a violent crime.

1) Possession of Heroin is a drug offence which requires strict action. As Fel
ony has committed first offence, therefore, criminal officer can inspect or threat him for the act.
2) For stealing $150 worth of calculators from Staples store, Misdemeanor can be charged with some monetary penalties or fines in order to teach him a lesson of not repeating the act again.
3) As a career criminal thief who has been prison to one time in the last 15 years ago, the thief should be charged with severe action (Renton, 2012).
