Simon and Lily are both 15 and studying at the same high school. They started dating since 14, and almost all of their classmates knew about it. One day, Lily invited Simon to visit her home when her parents were both out. Simon asked Lily for sex after a passionate kiss. Lily was hesitated, but she did not say yes or no, while let him take her clothes off. When Simon tried to have sexual intercourse with Lily, she was panic and said no to him. Simon thought that “when girls saying no means yes”, as his friends always say that to him. He finally had sex with Lily.


At the time when they just finished sex, Lily’s parents came back and found them naked in the bed. Lily’s parents were very angry and called the police immediately. Simon was arrested for having unlawful sexual intercourse with an under-aged girl.


Lily was feeling confused. She loved Simon so much, but shewasn’tsure if she wanted to have sex with him. On the other hand, she felt being hurt by Simon, as he did not stop even when she said no to him. She felt hurt as she was not being respected. However, she still loved Simon so much anddidn’twant him to be prosecuted.

Introduction
The judgement and sentencing of youth offences is a matter of in depth assessment of society, cultural values, personal impact and alignment of law and justice in a country or a state. The current report aims at finding the right course of legal actions for underage sex offence committed by Simon, a 14-year-old boy, who had sex with his 14-year-old girlfriend Lily. Although Simon forced Lily into intercourse, Lily was responsible for provoking Simon as she asked him to visit her house during the absence of her parents. She also did not stopped Simon from taking off her clothes.
Recommendations for the Case Study
Considering the tender age of Simon and Lily, the gravity of the offense and its implication on their families and society, it is evident that the case must be handed over to the control of youth justice conference as it is more effective in than the youth incarceration. As supported by Cullen (2018), cases of underage offences can only yield positive feedback in the future if the issues are sorted less formally, where discussion is of the priority. The youth justice conferencing, as stated by Blackley and Bartels (2018), in the given scenario would include an open discussion where the victim along with their family would face the accused along with his or her family. The entire proceeding would be done very rationally, as public prosecutor, youth offence officer and judicial personals would offer their comments and the scenario, which is ignored in most cases would be included, offering a better assessment of the situation (NSW, 2018). Underage sex offences are mentioned in the Youth Offenders Act 1997 (Part 5, Division 1) and therefore, must be managed through youth justice conference (NSW, 2016).
