Introduction and explanation of issue
Psychology is the science that deals with the state of mind of a individual or the branch of science that deals with the mental ailment of body rather than the physical ailment. A psychologist has a typical and yet difficult job that is to understand the state of mind of the patient and diagnose them based on the same. However, this profession is being abided by several ethics as well as associated federal laws and due to these limitations psychologist have to be aware that while working in accordance to the ethics any federal law is not being violated and vice-versa.
However, there are instances where psychological ethics may affect the federal regulations and vice versa. These can be the cases, which include the informed consent of the patient as well as while maintaining the confidentiality of the patient. Therefore, in order to work in accordance to either one the other law is being violated.
Issues influencing the psychology ethics from an objective perspective
While working with the patients the psychologist have to make sure that the confidentiality of the patient is being maintained. Confidentiality is the most important factor that plays a major role in establishing the trust factor between the patient and the psychologist. Further, as mentioned by Olivari, Munoz Sastre, Clay Sorum and Mullet (2015), confidentiality plays a major role while dealing the patients with chronic diseases and some cases where the patient may be involved, which they might not want to disclose in front of anyone.
Confidentiality not only include maintaining privacy but also it includes keeping the documents of the patient safe and secure and also out of reach from any external influence. Likewise, it is an ethical code that the psychologist have to follow confidentiality breach is also punishable by law and therefore is a federal legal entity (Brown, Armstrong, Bore & Simpson, 2017). Nevertheless, being an ethical code there can be certain instances where the psychologist or the doctor may have to breach the confidentiality that is may have to inform a third person regarding the issue that patient may be suffering from.
This can arise majorly if the patient’s life is at risk or when there are chances that the patient may be getting involved into something illegal. Whatever the scenario may be, the psychologist have to perform a confidentiality breach, which is against the ethical code of conduct, and here psychological ethics are effecting the federal laws because such an act also be punishable under federal laws. There can also be instances where federal issues can be affecting the psychological ethics and this has been majorly seen in the cases where the patient is under age.
