Describe the historical context of the judicial branch.
· The Bill of Rights was created in 1791. Many amendments were made to the constitution during this time relating to the rights of people, crime and discrimination.
Describe the philosophical differences between the two principal approaches to the
Constitution: pragmatists (developmentalist) and originalists (strict constructionist).
· Pragmatists believe that the meaning of the clauses in the constitution change over time according to the context.
· Originalists believe that the meaning of the clauses is constant and does not change with time
Understand and describe how each Justice explains his different view as to how the
Constitution should be interpreted.
· Justice Scalia believes that the constitution should be interpreted according to its original text and its meaning must not be changed with change in time and society. If there needs to be a change people can vote for that change and create it.
