Health Ethics (HLTH 5002) Assignment 1: Analysis of an ethical issue (40%) (2000 words) Course Objectives: 1,3,4 The aim of this assessment is to analyse a real-world ethical issue and discuss ethical theories of relevance to resolving the issue. You'll also demonstrate your ability to communicate information effectively to a chosen population, along with providing solutions or strategies to prevent the issue. Please make sure that you address the course objectives in your submissions. Topics and context for the assignment The ethics issue that you focus on for this assignment can be chosen from the following three topics: 1. Should the government pay smokers to quit? 2. Is it morally permissible for doctors to prescribe placebos to patients? 3. Should there be a human right to health? Why? Why not? Your task You will use the 6-step ethical decision-making framework introduced in Week 1 of the course to address the ethical issue, chosen from the three (3) options above. Structure of the Assignment The reflection should be structured in essay format, with an introduction and conclusion. It is helpful to use sub-headings throughout, as this will help you to structure your thinking and the flow of content, plus makes it easier for the reader. Introduction (5 marks) Provide an introductory paragraph that describes what will be addressed in the assignment. This will include stating the ethical issue to be considered in the assignment. Introduction
This assessment will address the real world ethical issue titled “Should there be a human right to health? Why or Why not?” using 6-step Ethical Decision Making Framework. The essay will be in support of this title and will include a comprehensive coverage of all the sections namely (a) Identify Stakeholders, (b) Data Gathering, (c)

6-Step Ethical Framework
(a) Identify Stakeholders
A. Individual Level: All the citizens including disadvantaged and marginalized people. The care provided, should respond to individual needs, preferences and values. Services should be safe, efficient, timely, equitable and effective.
B. Collective Level: Healthcare services and healthcare workers, people with disabilities, women with HIV, drug users, sex workers, indigenous populations, inter-sex and transgender people. All the stakeholders should be active participant of all stages of development cycle including analysis, assessment, planning, monitoring and implementation.
C. Organisational Level: Non Government Organisations, State and Federal Governments. Healthcare Policies, programs influencing health of people. The Information System of these organisations should be able to recognize the most needy and vulnerable groups of population. The health services should be integrated and provided throughout the life. The right to health is based on the access to food, education, work, information, housing and information. It involves both the entitlements and freedom that is right to control the body and health.
D. Social Level: Access to healthcare services and entitlements and means for achieving it should be non discriminatory and should not be provided on the basis of race, color, sex, political opinion, religion and social condition. There should be no discrimination on the basis of distribution of resources and health services. The care should be free from harmful delays and waiting times.
(b) Data Gathering
The right to health is affected by accessibility, acceptability, availability and quality of care along with assessment of these services for diverse set of people. The public health measures should be evaluated for screening of sickness for prolonging the life expectancy. The policies like Affordable Care Act have been helpful in providing equitable healthcare services for everyone, as most of the patients find the healthcare treatments out of their pockets (Arulkumaran, 2017).
The constitution of World Health Organisation (1946) adopted health as a fundamental human right and identified 10 December as Human Rights Day. According to this right, every human being is entitled to enjoy best possible health standard irrespective of any discrimination based on economic, political, racial or social status of the person.
World Medical Association also promotes and protects the right to health inclusively. It involves accessibility of affordable and quality services in healthcare, providing safe working conditions, good working environment and nutritious diet and sufficient housing facilities. In 1948, the health was considered as a part of right to adequate living standard in article 25 of Universal Declaration of Human Rights (World Medical Association, 2019). In article 12 of international covenant of Social, Economic and Human Rights, again it was identified as a human right in 1966. Full recognizant of this right was taken to reduce the still birth and infant mortality, to improve the industrial hygiene, prevent and treat the pandemic, and create conditions to assure medical attention for sick people.
The UN Committee on Economic, Cultural and Social Rights 2000 declared that Article 12 provides freedom to the people in obtaining best possible care in an equitable manner (Bernhardt, Forgetta & Sualp, 2020). The governing institutions should address four dimensions of human rights (accessibility, quality, availability and acceptability) when providing healthcare for everyone.
