Practical & procedural steps that are required prior to filing an application, if one has no marriage certificate under the Federal circuit are the-:
1. If the marriage is valid and recognized as valid as per the application of the law of the country in the place where the marriage took place;
2. If there is any specific marriage certificate or any related “record” or “entry” which was issued prior by the authority which can again “issue” that certificate in that country;
3. Mandatory condition is to attain 18 years of age at the time of the marriage or allowed in some cases of least 16 years of age
4. Another condition is that neither you or the spouse or priory married during the time of this marriage;
5. Attainment of the Consent provided by both parties
6. Some complicated relationship is not existing such as brother and sister.
If you do not have your marriage certificate, one needs to obtain a copy from Births or related copy of the Deaths and Marriages for a given state or territory in which one is married. Another condition if one is married overseas it should also contact the relevant authority of a particular country in order to avail a copy of your marriage certificate. Even after that, if one does not obtain a copy of marriage certificate one needs to also prepare and file an affidavit along with the application and providing a reason for not providing the certificate. It should done after seeking legal advice related to how to do this. The affidavit should detail about one marriage and detail reasons for not getting a copy of your marriage certificate.
