2 Students are required to read a decision of the High Court of Australia and then write a report on the “ratio” for that decision in response to specific questions




3 Each group is to submit a
joint
report for marking. The length is to be no more than 1200 words





THE CASE


The case for study is

AUSTRALIAN COMPETITION AND CONSUMER COMMISSION

[APPELLANT]

v TPG INTERNET PTY LTD

[RESPONDENT] (decided in December 2013)


· A copy of the High Court’s judgment is loaded separately.


· The first step is for students to read the judgment carefully.

To avoid any confusion among some students who are reading the High Court judgment about the roles played by the various courts which heard this dispute I provide the following short summary



The sequence of court hearings


· The Australian Competition and Consumer Commission (ACCC) brought proceedings against internet provider TPG because of an advertising campaign TPG had been conducting for internet services.


· Initially, the proceedings were heard by a single judge, who is referred to in the High Court judgment as the “primary judge". ACCC was largely successful against TPG in those proceedings.


· TPG, having lost the case before the primary judge, appealed to three judges, referred to in the judgment as the “Full Court". That court largely disagreed with the conclusions of the primary judge and set aside his decision. In effect, TPG won its appeal to the Full Court.


· This left ACCC as the loser. It appealed to the High Court, which disagreed with the conclusions of the Full Court in favour of TPG and essentially reinstated the decision made by the primary charge in favour of ACCC.


The judgment you are reading, and to which the assignment questions relate, is the judgment of the High Court only. However, to enable the "ratio" of its decision to be understood, the High Court includes in its judgment summaries of the reasons which the primary judge and the Full Court gave in coming to their respective (and contradictory) decisions.

Doing so will result in a high similarity index in Turnitin and a low mark for the group. One group in a previous trimester resorted to the cut and paste technique and was awarded 2/20; as a result, all but one member of the group failed BUS101.

The problems associated with the TPG advertising were:
1. The Australian Competition and Consumer Commission claimed that TGP Internet Pty Ltd. was making false and catchy
advertisements with hidden costs. TGP being a multimedia advertising company invited the consumer for an unlimited internet usage at an eye catchy price of $30. The advertisement was nevertheless misleading and deceptive in nature as the new customers were getting carried away with the low costing advertisement and in reality, it was forcing the customers to enter into a contract for the 24 months by making them avail a broadband through the landline and then making them subsequently pay for the additional add-on charges. This was entirely misleading which resulted in the cheating of the customers. The company had displayed a message which had a wrong content and intentions for the customers.
2. The advertisement shown in TPG’s campaign displayed that the company is supplying broadband internet ASDL2+ service for an amount of $29.99 and didn’t disclose a hidden cost of $129.95 as a setup fee and $20 for the telephone charging (UREL, 2017).
3. Also, they hide the truth in the advertisement that a working telephone line is must for the setup of a connection which would add to the existing cost of the setup. This had violated the section 53c(1) act which stated that there is a compulsion of disclosing all the paid service to the customers.

ACCC found that the TGP advertisement was misleading as it didn’t provide full information about the actual cost of setup, along with the bundle effects or any disclosed information. It was violating the provisions of the act as directed by the Trade Practices 1974. The violations were:-
1. Section 52- TGP’s advertisement was displaying a wrong information by promising a low cost but in reality, the customers had to pay high. It was misleading in nature and this section states that a corporation shall not engage in conduct of any misleading advertisement or clause neither in trade nor in commerce.
2. Section 53(C)- the actual cost of set up and installation was much more than the shown in the advertisement. This section prohibits such mal trade practices of not disclosing the actual cost to be incurred in the advertisement.
