Task: Report - Community Case Study


You may choose one of the networks/institutions/organisations that you identified as sites for information in relation to Indigenous knowledges/perspectives in Module 2 for this Assessment. Explore its activities in relation to the protection, maintenance and promotion of Indigenous knowledges and perspectives in culturally responsive ways in areas of Indigenous policy and advocacy.



This assessment will include:


- an introduction - explanation of what the study is about;


- a brief background information of the network/institution/organisation in relation to the nature of how its active social engagement in policy and advocacy reflects broader Indigenous contemporary perspectives;


- a highlight of ethics and protocols in accessing and utilising Indigenous knowledges - For example researching and working in Indigenous contexts;


- a critical analysis ofhow issues of Indigenous human, cultural and intellectual property rights are addressed - refer to and outline relevant guidelines, protocols and laws that protect human, cultural and intellectual property and copyrights when working in Indigenous contexts;


- a conclusion that summarises your analysis.

Apart from the recommended readings, you can search online and view various communities, universities, research institutions andorganisations including Australian Institute of Aboriginal and Torres Strait Islander Studies (AIATSIS) websites for their guidelines/protocols for ethical research in Indigenous studies - examples of communication protocols, requirements of researchers, language used etc.

Introduction
The Indi
genous community faces oppression and discrimination in many ways in the society even today. It has also been facing several challenges when it comes to its cultural and intellectual property. Amongst these many challenges, mainly there are issues of copyright, forgery and exploitation. The paper analysed in this report is titled “Indigenous cultural and intellectual property: the main issues for the Indigenous arts industry in 2006” (Janke and Quiggin, 2006).
The paper at length describes some of the major current issues faced by the indigenous population with regards to its intellectual and cultural property. It aims at informing the government of these issues and suggests relevant ways in which the government can tackle them. The paper uses a comprehensive framework to provide multiple perspective on the various issues. In discussing them, the paper also cites the various major studies and publication and authorities within its discussion to make it authentic. Finally, the paper provides some interventions that could be effective in tackling the highlighted issues.
Background on institution
Indigenous cultural and intellectual property rights in relation to the Indigenous people can be considered as basically, their cultural heritage. These rights hold the Indigenous as being rightfully entitled to protect and propagate their heritage which comprises of songs, stories, dances, objects, knowledge and images (Geismar, 2013). The paper has been published by the Australian Institute of Aboriginal and Torres Strait Islander Studies in association with the Aboriginal and Torres Strait Islander Commission, Sydney.
The Australian Institute of Aboriginal and Torres Strait Islander Studies has set itself on a mission to get the Aboriginal and Torres Strait Islander knowledge and culture the recognition and respect that they deserve in the world. They aim at preserving and providing access to authentic means of viewing and analysing the Aboriginal and Torres Strait Islander culture and heritage. They provide support and facilitate the regrowth of the Aboriginal and Torres Strait Islander culture. The also engage in research about them and maintain a hefty collection of their original heritage (AIATSIS n.d.).
Both the institutions have been extremely active in advocating and preserving the rights of the Indigenous and Torres strait islander population. These institutions have understood that the Indigenous heritage is something that is transmitted from one generation to another and each group has its own unique heritage. They see indigenous cultural and property rights to include-
