It is illegal to produce, possess, have under one's control, sell, give or deliver any narcotic drug or to prescribe or administrate distribute any narcotic drug except as provided in this subpart or to become an addict as described in La. Rev. Statutes 40:961. An "addict" is defined under section 40:961(1) as a person that frequently and excessively uses one or more of the prescribed narcotic medications listed in section 40:961, and who does not have a medical necessity to use such drug, or medicines. 40:961, 40:962 of the Louisiana Revised Statutes, on which he was tried and found guilty, were deemed unconstitutional by the defendant in State v. Bruno, 253 La. 669 (La. 1969). A drug addict, according to the defendant, is prohibited under Louisiana Revised Statute Ann. 40:961, 40:962. After determining that the legislation did not punish addiction itself, but rather the regular use of drugs that led to addiction, it rejected the defendant's appeal.
