The use of International Customary Law in Federal Common Law is significant with the consideration of constitutional challenges that pertain to the incorporation of customary international law within the common law. The challenges ascertained with respect to the institutions of democracy along with the federal jurisdictions and the doctrine associated with separation of powers (Sadat, L. N., 2015).
