Yes, Kay’s estate can definitely sue Dr. Grand in the home state of Kay.
It would be falling under the supervision of the laws by the medical board in the home state of Oklahoma where Kay resides.
With which of the providers has Kay formed a provider-patient relationship that might be the basis of a malpractice suit?
The treatment started with the diagnoses with cancer, which turned out to be the basic beginning of her entire treatment. The main and the basic care of her treatment started with Dr. Local, as he was the one who was the first one to diagnose cancer in Kay. Within these, Kay missed her first appointment. Dr. Local tried hard to arrange an appointment of her, but he failed on doing so with his follow up patients. He also tried checking it, if she needed an appointment for follow up.
Who (including MAMC) is liable for an inaccurate diagnosis or inappropriate treatment?
Is the standard of care the same for an in-person oncology consultation vs. a teleoncology consultation? Would it be helpful to establish telemedicine practice guidelines to help define/set the standard of care in a telemedicine consultation?
In this particular case Dr. Grand is totally liable along with the nurse, as he was being asked for examine the patient. The ways are quiet similar to the basic rule of the relationship of the patient-physician is generally creates when any physician acts affirmatively towards any case of the patient along with the patient herself. The entire process revolves around the examining, diagnosing followed by treatment and the medication, agreeing to doing all these also falls under this category.
