Your overall aim is to demonstrate your understanding of the unit content (legal and ethical issues, including professional codes and standards) and how they apply to the context of the case study in the video provided. To do this you will provide an analysis: a detailed examination. Use the applicable parts of the case study discussed in the video to demonstrate your understanding of the unit content e.g. beneficence, deontology, duty of care, tort of negligence, Registered Nurses Standards for Practice etc. This case study analysis essay word limit is 1800 (plus or minus 10% as per the School of Nursing & Midwifery Undergraduate Assignment Guidelines). All words are calculated towards the word limit except for the title page, direct quotes and end-text references. If you write less or more than this, penalties will apply. If you write less, it is unlikely you will have covered all aspects of the assignment. This assignment has a weighting of 40%. The assignment will be marked using the School of Nursing and Midwifery standard marking rubric, which you will find on the unit Blackboard site. Please read each criterion carefully and reflect the positive criteria in your essay. The following assignment brief is structured under the same headings as the marking rubric, please consider both documents carefully as you construct your essay. NUM1205 Legal and Ethical Requirements in Nursing and Midwifery Practice, Semester 1. 2020 2 Content You need to consider: • the use of an ethical decision-making framework when planning your work. • all the ethical and legal/professional concerns (introduced and discussed throughout the unit up to and including week 5) that the situation in the case study raises. Apply all the relevant unit content throughout the essay and relate it to the legal and ethical concerns that the situation in the case study raises. • the possible actions (or inactions/omissions) that could be taken and the implications from a legal and ethical perspective. Think of the possible courses of action, and inaction that could be taken, and then consider, do any ethical theories support (or not) the actions that you discuss? • you do not need to provide the ‘right’ answers. What you will be assessed on is your ability to determine the implications of different actions or inactions from a legal and ethical perspective. • which ethical principles, doctrines or concepts apply to the actions/inactions put forward and if so, how? • which torts or other legal concerns apply to your suggested actions/inactions? • do any of the ethical principles conflict with each other or with the law? • consider the application of professional codes of conduct and ethics Application of critical thinking You will be assessed on your ability to consider the implications of the suggested actions/inactions and the application of theory to practice. You will also be assessed on your ability to support the arguments you put forward with evidence from appropriate literature. There is a minimum of 8 references required, although you should read widely and incorporate that reading into your assignment – the more relevant references, the better! The more you read, the more evidence you will find to weave into your essay and support your ethical and legal claims. References for this essay should be within 5 years of publication – unless it is sentinel work. References should be from a valid source (peer reviewed journals, government and official health organisation and professional on line websites and resources e.g. Department of Health, Nursing and Midwifery Board of Australia etc., books) and all must be relevant to Australia. References should support the ethical and legal/professional information as oppose to nursing and medical diagnosis. Do not leave areas in your work that are unsupported by evidence. Each paragraph should include a reference. Check the similarity report and ensure that you have paraphrased information and provided a reference. Structure & presentation You should follow the School of Nursing and Midwifery Guidelines. There is no need for headings, the paper should flow in one long sequence. See SNM assignment writing guidelines for layout. You need to address the possible actions / inactions in a logical piece of writing that shows the possible implications of two different pathways of care / omission of care. The main part of the assessment is that each of those areas (ethics and law) contains appropriate material. NUM1205 Legal and Ethical Requirements in Nursing and Midwifery Practice, Semester 1. 2020 3 Your introduction should succinctly introduce what will follow. The main body should contain a logical and cohesive development of ideas and your ability to sustain logical arguments will be assessed. Your conclusion should provide a summation of the key points of the work. Full sentence structure is required. Do not rewrite the case study. Discuss the relevant parts of the scenario as you apply the relevant ethical theories, concepts, principles, legal and professional elements of the unit content It is recommended that you use the ethical decision making model discussed in the unit content (week 1 tutorial) to plan your work. Referencing You must comply with the ECU SNM assignment writing guidelines, follow these specific assignment instructions and use the ECU referencing guide to ensure all in-text and end-text references are correct. Please use the School of Nursing and Midwifery Assignment Guidelines and the ECU Referencing Guide to present your work. There is no excuse for deviating from these guidelines as they are available through several links, here, in the unit guide and on the Blackboard site. If you are unsure about referencing, see the Learning Consultant early in the semester. There have been some very recent changes to APA 6th referencing guidelines and now the latest version is APA7th. You will not be marked down for using APA6th, hover you may want to access resources from the library outlining the changes for the future. English language proficiency (ELP) As with all written assignment work that you undertake at ECU, you will be assessed for ELP within this assignment. NUM1205 is not a prescribed unit for ELP, so the weighting against this criterion is not as high as in the prescribed units. However, you should make every effort to ensure that you pay close attention to the construction of sentences, ensuring spelling, grammar and syntax are correct. Poor writing will detract from the content of the essay if you are unable to articulate the true meaning that you are trying convey and this may lose valuable marks. ** If you are at all concerned about your written work please see support, from the academic writing resources available in the university, early in the semester (see tabs under ‘Finding Help’ on the left side of the Bb site). CASE STUDY ANALYSIS
The contribution of Florence Nightingale towards the service of mankind discovered the Noble profession of nursing and from there this evolved human civilization started including this profession in the area of healthcare services. The pious job of nursing not only related to the care of the patient but also
it is related to the internal bonding with the patients’ mental health. The job of the health care staff is to understand the patients need and according to that the special care is be provided in case of improving the health of the patients. Nowadays all over the world, medical institutions provide nursing as an area of study and career to choose on. With the change of technology and discoveries in the field of medicines the nursing programs also changed accordingly (Curtis, Fry, Shaban & Considine, 2017). From the last two decades, it's also been an appealing profession among youth. The healthcare sector is also an organized sector that provides jobs and services to citizens, comprising several departments to handle and a huge no of human resources and machines to direct. So in doing so, any organization needs some standard ethics and law for the functioning of the organization, and also any profession is associated with some ethical values which are usually taught in getting professional education. As every country has a different constitution and legal system, the ethical standard for every profession and organization is also different and with time it demands changes. The pressure of providing good healthcare and managing limited resources for a growing population has always been a challenge and maintaining balance is a tough task. Therefore it attracts some illegal activities and unethical practices. The laws are there to tackle the same but either it takes a lot of time or it may happen some lives are sacrificed. The family of the deceased suffers the most because sometimes the case of medical negligence is not known to them and hospital authorities take the best way possible to maintain the reputation of their staff and hospital (Nursing and Midwifery Board, www.nursingmidwiferyboard.gov.au ). Though sometimes it becomes an unsolvable puzzle of finding out who is responsible and to whom the blame should be put.
The code of professional conduct of Australia has outlined the needed behavior and conduct of nurses by considering all the desirable cases. It is also designed for the nursing authorities, the person receiving nursing care, nursing students, and healthcare workers. The purpose behind it was to regulate the minimum national standard for all the communities throughout the country to follow and also obliged the recruiting authority to take it as testing criteria to keep in mind. The breach of this code will be taken as professional misconduct and legal action can be taken when in need. So, all medical professionals are obliged to follow. These regulations restrict them to share confidential and private information of the patients and also this ethical code builds a trustworthy relationship with patients which helps them to negotiate any medical treatment (Reynolds & Mitchell, 2019). In a small-time, faith is developed in the heart of the patients that if anything happens while in hospital these nurses and doctors will try every effort to cure them. But it takes only a minute of negligence to break the trust which sometimes can result in death and serious medical issues. Like what happened with Mrs. Donoson in the case provided. The mere health issue led to blood clotting in the head which resulted in...
