This paper provides an opportunity to retrieve, analyze, and evaluate real-world errors in healthcare. In response to these adverse events, the student assumes the perspective of an institution's risk manager by analyzing causal and contributing factors and proposing mitigating factors as safety tenets for adoption by the institution. Students will apply critical thinking, problem-solving, writing skills, and quality and safety principles in healthcare.


Instructions: Compose a five to six-page paper with the following sections:




  • Find three legal cases that involve negligence in the healthcare setting. Based on the details of what went wrong in these cases, develop a prevention plan to mitigate risk.



    • Be sure to include a definition of negligence in the introduction (cite this).

    • Write at least one page of content for each case:

      • Include at least three preventive measures for each case.

      • Describe one of the ethical principles that were violated.

      • Describe one of the regulations or standards of practice that was violated.

      • How could the injuries or negative outcomes in these cases be prevented? What actions do you recommend for health care professionals or health care organizations? If you were the director of a facility what new policies/administrative actions would you implement to mitigate this risk.



    • Provide reasoning for your recommendations.

    • Provide at least 4 citations, including the textbook.




Each Section must be a minimum of ½ page and a maximum of one full page. The paper should be a minimum of five and a maximum of six pages with the title page and reference page.

Introduction
    In the healthcare section, medical negligence means failure of the act in accordance with the standards of reasonable competent medical man at times. This medical negligence cases happens in various hospitals and other medical care centres where some patients suffer because of diagnosis errors, misreading or ignoring the laboratory results, surgical errors, unnecessary surgery and many more (Uma, Ramani and Sherlin, 2020). This paper would deal with three such case studies which had dealt with medical negligence and the preventive procedures to mitigate the risk.
First Case Analysis of Medical Negligence
    As stated by Khan, Bastiampillai and Mon, (2020), medical negligence is an act or omission that departs from the accepted medical standard of care. Negligence is one of the most important areas which covered as well as protects various interests of human life. Medical negligence is totally related to the healthcare field where due to certain ethical as well as legal issue patient remain untreated or treatment done without sufficient results. Due to this negligence the patient and their family usually start disrespecting the institution and finally quit taking service from them.
Through this Khan, Bastiampillai and Mon, (2020), particular case study, it is clearly notable that there may be many ways where a doctor may be said to have omitted certain act such as not following the procedures, giving patients wrong advice, and prescribing the wrong medication and deterioration of the patient’s condition after surgery. One wrong step would lead to a drastic change in patient’s condition. If the step is considered to be a right one then the condition of the patient would change towards progression and improvement, but if ever the condition decline, then it would really hamper the condition of the patient. This case study deals with challenges and litigation and their further effect on the patient parties. The litigation process takes a long time to judgement and it is comparatively expensive one. There remains a high possibility that the victim may not obtain any compensation due to the instability, this litigation process might ruin the relationship between the patient and doctor because of the confrontational elements during the trial.
The preventive measures after analysing the specific case study would be like firstly, prioritising the communication quality and level and improve the diagnosis procedures. Communication between the doctor as well as the nurses should be effective enough and each and every detail of the patient should be understood and discussed by them. Secondly, this litigation procedure should be improved, biased and remain equal for all.
